Thank you for using the services of Keep Prep ("us", "our services" or "our application")! Please read these Terms of Use carefully before using them, as they contain important information about your rights and obligations. It also includes various limitations and disclaimers. These Terms of Use ("Terms") govern your use of the Keep Prep service.

By continuing to use our services, you agree to be bound by all of these Terms. If you do not agree to any of these Terms of Use, you should immediately stop using our services and uninstall our application.

Keep Prep does not provide exam, medical, fitness or other advice. We are not affiliated with, and do not represent the position of, any government agency, test administration or test center in any country. You understand and agree that we are only providing a question practice service and that just because you get a good score (over 75% accuracy) on our app does not mean that you will definitely pass the exam, and that all exam activities are at your own risk.

1. Agreement to Terms

1.1 By using the Keep Prep website, services and mobile applications (collectively, "Keep Prep"), whether as a guest, free trial user, unsubscribed user or subscribed user, you accept and agree to be bound by these Terms. It is your obligation to carefully read all of these Terms, as well as Keep Prep's Privacy Policy, before using our Services. If you do not agree to these Terms or the Privacy Policy, please do not continue to use Keep Prep's services.

1.2 By continuing to use, you acknowledge that you have read and understood these Terms and that you accept to be bound by them.

1.3 By using our Services, you represent and warrant to us that you are at least 16 years of age and have the legal authority, right, capacity or license to act as required to agree to these Terms. If you are under 16 years of age, you represent that you have the authorization of your parent or legal guardian to consent to your use of our Services. Thereafter, you automatically agree to all of our amendments to these Terms.

1.4 In these Terms, "we", "us", "our", "our services", "our application " all refer to Keep Prep.

2. Changes to the Terms

We may revise and adjust these Terms from time to time in our sole discretion without your consent. Any changes to these Terms will be effective immediately upon posting. By continuing to use our services after we post revised terms, you represent that you have read and understood these terms and agree to accept all changes.

We reserve the right to send you reminders or notices if we make material changes to the Terms of Use. We recommend that you review these Terms periodically, and we will indicate changes to the Terms by adjusting the final modification date at the top of the page.

Keep Prep provides the Terms of Use in English. If we provide a translation of these Terms of Use in a language other than English, or if you translate these Terms of Use yourself using a translation tool, then you agree that the translation is provided solely as a convenience to you and that the English version of the Terms of Use will govern your relationship with Keep Prep. In the event of any inconsistency between the English version of these Terms and any other translated version, the English version shall control.

3. Access to Keep Prep

3.1 Keep Prep's services are dependent on databases, technologies or systems over which we may not have full control for their operation and access. As a result, we also cannot fully guarantee continuous accessibility or uninterrupted operation during your access to Keep Prep's services. If there are interruptions or delays during your access, you understand and agree that we will not be liable to you.

3.2 We may suspend, discontinue or terminate the right to operate Keep Prep at any time, and any part or all of our application may be changed, deleted or any other adjustments may be made at our sole discretion without notice.

3.3 During your access to Keep Prep's services, you must comply with local laws and undertake not to damage, copy, overload or jeopardize the security of our systems, databases and servers in any way. Nor shall you infringe our or any third party's intellectual property rights.

3.4 If you do not comply with any part of these Terms of Use, we may, in our sole discretion, suspend, restrict or cease all access to Keep Prep.

4. Change to Keep Prep

As a service provider, we always want to provide you with uninterrupted operation of the service, but we reserve the right to change some or all of the functionality of any Keep Prep application at any time, and we may choose to discontinue, suspend or terminate the provision of the service at any time without notice. We will not be liable if for any reason some or all of our services are unavailable.

5. Account Registration and Security

The Services provided by Keep Prep do not currently offer the ability to create an account, but in order for you to use certain advanced features of our Services, you may be required to provide your Apple ID or Google email. This information you provide will be used as part of our security procedures, and you agree to treat this information as confidential and agree to notify us immediately of any unauthorized access to this information or breach of security elsewhere. We reserve the right to immediately prohibit or suspend you from using this information to continue accessing our services with or without notice to you if we believe that you have violated any of these Terms of Use.

6. Subscription Fees and Payments

Keep Prep will introduce certain premium features and content based on the applications offered, which you may choose to purchase on a weekly, monthly, quarterly, annual, or lifetime basis, depending on your needs. A description of the features and content associated with the subscription is available at the time of subscription. You may also choose to use the basic version, which allows you to use some of the features and content of our apps even if you do not pay for a premium subscription.

When you purchase a subscription, you represent and warrant that you have the legal right to use all payment methods represented by any such payment information. The plan you subscribe to will be automatically charged upon expiration, if you wish to cancel your subscription you should do so yourself no later than 24 hours prior to the renewal expiration date. Otherwise, you agree that the amount due for auto-renewal upon expiration will be processed automatically by the payment method you have provided.

The reason we offer the Premium version is to ensure the proper operation of our services and we will continue to improve the quality of our services for you by updating and maintaining the version of the application. Once you have purchased any of our subscription products, you become a subscriber of our subscription, the full price and description of the subscription plan should be found on the subscription page, and we reserve the right to modify the subscription period, price, and the features and content available during the term at any time without prior notice.

Unless otherwise stated, all subscription products offered by us are denominated in U.S. Dollars, and the Apple or Google Store may show you locally converted prices (which may be subject to local taxes) based on the policies of the platform, and you understand and agree that all such prices are subject to change without notice to you. You should read the description of all subscription plans and free trial periods for yourself before paying for a subscription, and by making a payment you agree to all of our payment terms.

If you purchase a subscription with a free trial period or use a voucher provided by us, these subscriptions will automatically be converted to a paid subscription upon expiry. You agree that if you do not voluntarily cancel your subscription within 24 hours prior to the expiration of the free trial period, you are deemed to have agreed to proceed with a paid subscription, and each subsequent time the subscription expires the payment will be automatically deducted. If our apps or services offer a free trial period, all such unused portions will be deemed to be automatically forfeited when you purchase any subscription.

All paid subscriptions offered by Keep Prep are auto-renewal type subscriptions, which means that you agree to voluntarily turn off the corresponding auto-renewal option in your Apple or Google account settings at least 24 hours before the expiration date of the paid subscription you have chosen if you want to cancel it. All payments will be deducted from your iTunes or Google id account immediately upon confirmation of your purchase. You are not allowed to cancel your subscription during the active subscription term. You are responsible for managing your purchased subscription yourself, including suspending, upgrading or terminating the subscription program. If you voluntarily remove our application from your device, you agree that this action will not allow you to cancel your subscription or invalidate a subscription that has already been paid for.

If you have any concerns or disagreements about the cost of your subscription, you should first raise them with us, and you agree not to cancel or decline any credit card or third-party payment processing fees of your choosing until we have reached an agreement.Keep Prep reserves the right not to process or cancel your subscription in certain circumstances. If we suspect that your payment is fraudulent in nature or otherwise appropriate, we reserve the right to take any steps to verify your identity in connection with your order. We will not be liable to charge you or refund any fees for orders that we have not processed or canceled.

If you are downloading our Apps on a mobile device such as a cell phone or tablet, you may be charged by your communications service provider. You should check all the terms of your agreement with your carrier for yourself. If you use your cell phone to send text messages or make voice calls, or any actions related to the use of our services, you may be charged by your carrier for text messages or other operational costs in accordance with the standard. You shall be solely responsible for all such charges. If you do not pay the bill associated with your cell phone or tablet device, we assume that you have the permission of the appropriate person before incurring any of these charges.

7. Your Reliance on Information

All information or content provided on or through the Keep Prep application is for general operational purposes only, specifically we primarily provide questions for you to practice using. However, we do not guarantee the accuracy, completeness or usefulness of such content, nor do we represent that you will pass the real exam after passing our quizzes. Any reliance you place on such information is at your sole risk. We are not responsible for any liability or responsibility incurred by you or anyone else as a result of your reliance on our information.

8. Third Party Links and Services

8.1 Keep Prep may contain links or content to other websites or resources owned and/or operated by third parties. We have no control over these resources and content and these linked sites are provided for your convenience and information only. You understand and agree that any linked sites do not represent an endorsement or approval by Keep Prep of them.

8.2 We have no obligation or responsibility to monitor and are not responsible for the content, resources, hyperlinks, accuracy, or privacy policies of any Linked Sites displayed on our Application or Services, and make no warranties with respect to their content. We do not accept any responsibility for them or for any loss or damage that may result from your use of them. If you decide to access any of the third party websites or resources linked to Keep Prep, you do so entirely at your own risk and subject to the terms and conditions of use of those websites, which shall prevail over the terms and conditions herein in the event of any inconsistency between those terms and ours.

8.3 Keep Prep may also contain advertisements provided by third party advertisers. The display of any such advertisements does not imply a recommendation or endorsement by us of the relevant advertisement, its products or services or any other linked website. We are not responsible or liable to you or any third party for the content or accuracy of any material provided by any third party.

9. Disclaimer of Warranties

During your use of the applications or services provided by Keep Prep, you understand and agree that any features, content, services or items obtained through Keep Prep are at your sole risk. All content is provided "as is" and on an "as available" basis without warranty of any kind, either express or implied. neither Keep Prep nor anyone associated with it makes any warranties or representations as to the completeness, reliability, quality, accuracy, security or availability of Keep Prep. It also does not warrant that any version, feature or content you use will be accurate, reliable and uninterrupted.

We will promptly correct any errors we discover and submit updated versions, and we endeavor to ensure that the version or server you are using is free of viruses or other harmful components and that the features and content we provide meet your needs or expectations.

Keep Prep hereby disclaims all warranties or undertakings of any kind, whether express or implied, statutory or otherwise, including, without limitation, any warranties of merchantability, non-infringement and fitness for a particular purpose.

The foregoing is without prejudice to any warranty which cannot be excluded or limited under applicable law.

10. Limitation of Liability

10.1 We hereby disclaim all liability to you or any third party for any loss of profits or any indirect, incidental, exemplary, special or consequential damages arising out of these Terms of Use or your use of, or inability to use, our services (including applications and content) or products or third party advertisements under any circumstance, even if we have been advised of the same of the possibility of such damages. your access to and use of the services (including the application, content) and third party advertisements are at your sole risk and consequence.

10.2 Notwithstanding anything to the contrary in these Terms of Use, you understand and agree that Keep Prep's total liability to you for any consequences and claims arising out of your use of the Application, Features, Services, Content, or any other offerings is limited to the amount you paid to us for use of the Services. The above limitation of damages is an essential element of the basis of the Terms between Keep Prep and you.

10.3. if you are a California resident, you hereby waive California Civil Code Section 1542, which provides that "[t]he general release does not apply to claims that the creditor or releasing party did not know or suspect to exist in its favor at the time of executing the release, and which, if known by the creditor or releasing party, would have materially affected its settlement with the debtor or released party."

11. Indemnification

You agree to indemnify and hold harmless Keep Prep, its affiliates, licensors, and service providers, and their respective officers, employees, directors, and agents, from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees, including attorneys' fees.

12. Waiver and Severability

Keep Prep may waive any of its rights under these Terms only in writing. If we waive a default against you, we will only do so in writing, which does not mean that we will automatically waive any subsequent defaults by you. If any provision of these Terms is found by a court or other tribunal of competent jurisdiction to be invalid, illegal, or for any reason unenforceable, that provision shall be struck down or limited to the minimum extent necessary so that the remaining provisions of these Terms will continue in full force and effect.

13. Termination

We may terminate our services to you, including access to and use of any of our applications, services, and content, at any time in our sole discretion and without notice. You may also cancel or delete your account and personal information at any time by emailing us at contact@keepprep.com. If you subscribe to Keep Prep services, content or features, you should cancel your subscription with the Apple or Google Store yourself.

14. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Thailand. Any dispute arising out of or relating to these Terms of Use, including any question of its existence, termination or validity, shall be submitted to and finally determined by the courts of Thailand.
